These Terms of Sale (ToS) govern all orders for products and services placed on digitip.app. By confirming an order, the buyer unconditionally accepts these Terms. Seller: YUZU LABS SAS, 11 rue de Lorraine, 68490 Petit-Landau, SIREN 994 879 013, contact@digitip.app.
1. Products and services
YUZU LABS SAS sells under the Digitip brand: (1) pre-programmed NFC epoxy plaques ("SmartTags") enabling customers to leave contactless tips; (2) access to the Digitip software platform (dashboard, staff management, analytics, monthly statements and their delivery to the accountant), with no subscription; (3) the optional Digitip Pro subscription, reserved for professionals, whose content, free trial, subscription and cancellation terms are set out in section 15 of the Terms of use. The essential characteristics of each product are detailed on the order pages and on the Billing page. The Digitip Pro subscription, monthly or yearly, is payable in advance and renews automatically at each term. It may be cancelled at any time from the Billing page: cancellation takes effect at the end of the period already paid, with no pro-rata refund, and the business then returns to the free plan. The 30-day free trial requires no payment method and stops by itself at its end, at no cost. If the subscription is taken during the trial, or if a trial period is shown on the payment page, the first charge happens at the end of that period unless cancelled beforehand; a reminder email is sent about 3 days before.
2. Pricing
Prices are shown in euros excluding VAT. Applicable VAT is calculated by Stripe at checkout based on your country of tax residence. The Digitip Pro price is shown, per month and per year, on the Billing page and on the payment page before any subscription. YUZU LABS SAS may change its prices: any order is invoiced at the price shown when it is confirmed, and any increase in the subscription price is notified to the subscriber at least 30 days before it applies, the subscriber being free to cancel at no cost before that date. SmartTag delivery is free to the delivery countries offered (European Union and Switzerland).
3. Orders
Any order placed on digitip.app constitutes acceptance of these Terms, the prices, and the product descriptions. YUZU LABS SAS reserves the right to refuse or cancel any order in cases of suspected fraud, unresolved prior dispute, or product unavailability. A confirmation email is sent within 24 hours of validation.
4. Payment
SmartTags are paid in full online at order time through Stripe (bank card, Apple Pay, Google Pay). The Digitip Pro subscription is charged automatically by Stripe at the start of each period, to the payment method saved when subscribing; an invoice is issued for each charge. Payment data is collected and processed exclusively by Stripe: YUZU LABS SAS servers never see or store any bank data. If an order payment fails, the order is cancelled automatically; if a subscription charge fails, section 15.5 of the Terms of use applies. For business buyers, any amount unpaid when due automatically incurs late-payment penalties at three times the legal interest rate and a fixed recovery fee of €40 (article L441-10 of the French Commercial Code). No discount is granted for early payment.
5. Delivery
SmartTags ship from France within 3 business days of payment confirmation. Shipping is free to the EU countries offered at checkout and to Switzerland. For Switzerland the sale is an export invoiced without French VAT; Swiss import VAT and any customs duties are paid by the buyer. A tracking email is sent on dispatch. YUZU LABS SAS is not liable for delays caused by the carrier, force majeure, or incorrect delivery details provided by the buyer.
6. Right of withdrawal
Under article L221-18 of the French Consumer Code, any consumer (non-business buyer) has 14 calendar days from receipt of the parcel to withdraw, without giving a reason or paying a penalty. Products must be returned as new, unused, in their original packaging, at the buyer's expense. The refund is made within 14 days of receiving and checking the return. This right does not apply to orders placed for business purposes (B2B), nor to products used or damaged after receipt. As Digitip Pro is reserved for professionals, it carries no right of withdrawal; the free trial lets you evaluate it at no cost, and it can be cancelled at any time. Money-back guarantee: in addition to the right of withdrawal, and including orders placed for business purposes, any buyer can get a refund of their SmartTag order within 14 calendar days of receiving the parcel, without giving a reason, by writing to contact@digitip.app and returning the SmartTags complete and in good condition. The price paid is refunded within 14 days of receiving the return. Return costs remain with the buyer. This guarantee does not cover the Digitip Pro subscription.
7. Legal warranties
SmartTags benefit from the statutory warranty of conformity (Articles L217-3 et seq. of the French Consumer Code, 2 years from delivery for non-professional buyers) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). In addition, YUZU LABS SAS offers a lifetime commercial warranty: any SmartTag showing a manufacturing defect or failure under normal use will be replaced free of charge upon sending a photo to contact@digitip.app.
8. After-sales service
For any after-sales request, contact contact@digitip.app with your order number. YUZU LABS SAS will respond within 48 business hours and process any guaranteed replacement within 5 business days of confirmation.
9. Service fee on tips
Using the Digitip platform to collect tips does not result in any deduction from the tips collected: the recipient receives the full amount chosen by the customer. The service fee (a fixed part of €0.25 per transaction and a variable part of 5% of the tip) is added on top of the tip and paid by the person leaving it, who is shown the exact figure before confirming payment. That fee covers payment processing (Stripe), infrastructure hosting, fraud prevention and service maintenance. No fee is due if no tips are collected.
10. Liability
YUZU LABS SAS cannot be held liable for indirect damage (loss of profit, loss of customers, loss of data) linked to the use of, or inability to use, the SmartTags or the platform. YUZU LABS SAS guarantees no number of Google reviews and no rating as a result of the Digitip Pro subscription. The liability of YUZU LABS SAS is limited to the amount actually paid by the buyer in the 12 months preceding the damage.
11. Disputes and mediation
In the event of an unresolved dispute, any consumer may use a free approved mediator: CM2C, Centre de la Médiation de la Consommation de Conciliateurs de Justice, 14 rue Saint-Jean, 75017 Paris (www.cm2c.net). Disputes between professionals fall under the exclusive jurisdiction of the courts of the Colmar Court of Appeal, unless mandatory law provides otherwise. These Terms are governed by French law.
