These Terms of Sale (ToS) govern all orders for products and services placed on digitip.app. By confirming an order, the buyer unconditionally accepts these Terms. Seller: YUZU LABS SAS, 11 rue de Lorraine, 68490 Petit-Landau — SIREN 994 879 013 — contact@digitip.app.
1. Products and services
YUZU LABS SAS sells under the Digitip brand: (1) pre-programmed NFC epoxy plaques ("SmartTags") enabling customers to leave contactless tips, and (2) access to the Digitip software platform (dashboard, staff management, analytics). Essential product characteristics are detailed on the order pages.
2. Pricing
Prices are shown in euros excluding VAT. Applicable VAT is calculated by Stripe at checkout based on your country of tax residence. YUZU LABS SAS reserves the right to change prices at any time; orders are invoiced at the price shown at the time of confirmation. Delivery is free across Europe.
3. Orders
Any order placed on digitip.app constitutes acceptance of these Terms, the prices, and the product descriptions. YUZU LABS SAS reserves the right to refuse or cancel any order in cases of suspected fraud, unresolved prior dispute, or product unavailability. A confirmation email is sent within 24 hours of validation.
4. Payment
Payment is made in full online at the time of order via Stripe (debit/credit card, Apple Pay, Google Pay). Payment data is collected and processed exclusively by Stripe — YUZU LABS SAS servers never see or store any banking data. In the event of payment failure, the order is automatically cancelled.
5. Delivery
SmartTags are dispatched from France within 3 to 5 business days following payment confirmation. Delivery is free across Europe. A tracking email is sent upon shipment. YUZU LABS SAS cannot be held liable for delays attributable to the carrier, force majeure, or incorrect delivery information provided by the buyer.
6. Right of withdrawal
In accordance with Article L221-18 of the French Consumer Code, any consumer (non-professional buyer) has 14 calendar days from receipt of the parcel to exercise their right of withdrawal, without reason or penalty. Products must be returned unused, in their original packaging, at the buyer's expense. Refund will be made within 14 days of receipt and verification of the return. This right does not apply to orders placed for professional purposes (B2B), or to products that have been used or damaged after delivery.
7. Legal warranties
SmartTags benefit from the statutory warranty of conformity (Articles L217-3 et seq. of the French Consumer Code — 2 years from delivery for non-professional buyers) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). In addition, YUZU LABS SAS offers a lifetime commercial warranty: any SmartTag showing a manufacturing defect or failure under normal use will be replaced free of charge upon sending a photo to contact@digitip.app.
8. After-sales service
For any after-sales request, contact contact@digitip.app with your order number. YUZU LABS SAS will respond within 48 business hours and process any guaranteed replacement within 5 business days of confirmation.
9. Tip commission
Using the Digitip platform to collect tips triggers an automatic 5% commission on each tip collected. This commission, deducted by Stripe at the time of payout, covers payment processing fees (Stripe), infrastructure hosting, fraud prevention and service maintenance. No commission is due if no tips are collected.
10. Liability
YUZU LABS SAS cannot be held liable for indirect damages (lost profits, loss of customers, data loss) related to the use or inability to use SmartTags or the platform. The liability of YUZU LABS SAS is limited to amounts actually paid by the buyer in the 12 months preceding the loss.
11. Disputes and mediation
In the event of an unresolved dispute, any consumer may use a free approved mediator: CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice, 14 rue Saint-Jean, 75017 Paris — www.cm2c.net. The European Commission also provides an online dispute resolution platform: ec.europa.eu/consumers/odr. Disputes between professionals fall under the exclusive jurisdiction of the courts of the Colmar Court of Appeal, unless mandatory law provides otherwise. These Terms are governed by French law.
